Advantages of bankruptcy

Bankruptcy is a financial state in which a debtor is unable to pay their debts as they fall due. The main aim of bankruptcy is to distribute the assets of the bankrupt among the different creditors and release the debtor from any further liabilities.

Following are some of the benefits that bankruptcy provides to the different parties involved such as the debtor and the creditor:

  • Stopping the procedure of collection. This in turn means that the creditors should stop the attempt to collect on debts.
  • Allowing the discharge of most of the debts, if not all. This shows that the debtor is no longer obligated to pay back the respective debts.
  • It provides the debtor with a chance to dispute respective false claims from the creditors who would be trying to collect more than the amount actually payable to them.
  • Avoiding the physical and emotional drain bankruptcy causes on the person concerned after he or she is declared bankrupt. In order words, there is relief from pestering creditors once the party has been confirmed bankrupt.
  • Once the court declares a person to be bankrupt, an Official Receiver will take the power of the administration along with doing the decision-making about the repayment of the debt amounts. Such an action frees the debtor from the further depression and stress.

The two major purposes of the state of bankruptcy include:

  • To provide the creditors with a fair share of the amount that the debtor can afford to give back.
  • To provide the debtor with the facility of starting afresh by discharging the earlier debts.
