False Claims from the IVA Council
If the IVA Council have written to you, make sure you read this...
Some of our clients have received correspondence from the ‘IVA Council’ warning them that their IVA may have been mis-sold. The IVA Council claim that the debtor could be eligible for a refund of fees and contributions, offering a “government licensed debt adjuster” to support this claim.
The IVA Council has previously been exposed for making false claims in its letters and suggesting it is affiliated with the Insolvency Service. The Insolvency Service has confirmed that there is no relationship between itself and the IVA Council and have appointed lawyers to investigate the situation.
The actual details of your IVA are confidential to Debt Lifeboat and the IVA Council are sending unsolicited mail to addresses found on the Insolvency Service website.
If you have received a letter from the IVA Council, you need to be aware of the following:
- Failure to make agreed contributions into your IVA could result in failure and lead to Bankruptcy
- The IVA Council is offering debt advice without meeting the requirements of the Office of Fair Trading, namely the display of the ‘Consumer Credit Licence’ number on its website.
- The IVA Council offers no ‘Data Protection’ registration details, necessary when a business records data.
- The IVA Council has failed to provide company details, registration number or registered office on its website, all legal requirements for a Limited Company in the United Kingdom.
