Debts can be a serious problem that lead to financial hassles. If you fall behind in repaying debts to creditors, your creditors can apply for County Court Judgments to make provisions for you to repay the debt owed. Before applying for a County Court Judgement, however, the creditor must have issued you with a default notice.
Once a claim has been submitted to the court, you will be issued with a County Court Summons. This is a legal document, stamped by the court, giving details of the creditor’s claim and providing a response pack.
The response pack contains forms to be used in defence against details of the claim, such as the amount owed. Additionally, forms are included for you to admit the debt, if appropriate, and an acknowledgement of service that provides time for the debtor to complete the papers and submit them to the court.
Once all the documents are completed, it is essential to respond within the allotted time in case you have filed an acknowledgement of service. Once the admission form is filed, the court asks you to complete the details of your income and expenditure in order to ascertain all the debts.
In you fail to pay off the debts subject to a County Court Judgement, the court may begin alternative recovery processes, such as appointing bailiffs, issuing a charging order on your property or issuing an attachement of earnings order so as to recover the debts owed.
