Balifs Threats to Property

A balif is the person who is authorised as the debt collector. A balif must carry the warrant or the warrant of execution which is issued by the concerned court. The balifs threats to property can peace fully enter your house and have the right to search the entire house to look for the property of value which can be taken way or either being sold to pay the debt. Most often the property they want is listed before or even sometimes they clearly marked as the property which has been seized, they put their mark on it. They have their own ways to collect the different properties like they can leave someone at home while they can go and arrange the papers to collect the property or even they can ask you to sign the “walking possession agreement” which is more famous these days. This will mean that you agree with the balif that now the goods belong to him and you will not remove the goods. He can anytime return to take possession over these goods and can sale them as he please to schedule the money you owe.

In addition to the amount of debt and the cost of the court you will have to pay for each visit made by the balif. So it has to be taken care that if they return frequently your debt may increase with their costs. The most important point that has to be taken care is that once the balif enters the house peaceably then he has the right to enter forcefully to collect the goods at a later date. A balif does not have any right on the goods that are not yours but when they enter your house they will assume that everything kept there is yours until the real owner of the goods prove that he has the right over those things. To avoid these kind of situation you can show the receipts or the rental agreements of the goods which do not belong to you before they are seized by the balifs.

Balifs threats to property cannot overtake any tools, equipments or the vehicles which are used by you as a source of employment, occupation or trade. Also the things that are necessary to fulfil the daily needs cannot be seized which includes the fridge, clothing and crockery. If you have more than one TV then they can leave you with one and take the rest also the things like DVD can be taken away for sale.
