IVA Clears £94k Debt
Mrs B was a director of a small retail business that went into liquidation and she had personally guaranteed certain of the company's debts. In addition, she had personal debts with banks that she had accumulated supporting the business. In all, her debts totalled £94,400.
The proposal was that her husband would inject £37,000 into the Arrangement in full and final settlement of all claims. When it came to the creditors meeting, only one creditor who was owed £45 voted and that vote was in favour. It is only those creditors who actually vote who decide the outcome of the creditors meeting and therefore that one vote was sufficient to bind the other £94,355 of creditors into the Arrangement.
The Arrangement was concluded within twelve months with 33 pence in the pound being paid to creditors. Therefore, by using the procedure, Mrs B was able to write off £57,355 of her debts.
